There has been a recent change to the Competition Act in Canada via a couple of sections within Bill C-59 regarding statements made by any corporation regarding the efficacy of their efforts to mitigate climate change or reach Net Zero targets. Making false or misleading claims is known as ’greenwashing’ and has been part of Competition Bureau legislation for a long time. “Greenwashing“ refers to making claims that your company activities, policies or materials supply chain is somehow ’saving the planet’...when factually it is just a patina, not based on verifiable facts or reality. However, “Greenwashing“ as per Bill C-59, is now stringently precluded and millions of dollars of penalties have been prescribed for violations, where before the Competition Bureau generally required a ’behavioral change’ (i.e. modify the ad in question).
