Syncros Trail Fender Clearance Issue (air let out to demonstrate issue)

Looks cool, but has issues (air let out to demonstrate issue). When the fork is pressurized for the correct sag, the fender will hit the crown occasionally if I land hard off of a jump or drop, or hit a harsh transition. In my opinion, the fender should never be able to contact the fork crown. I did add some volume spacers, and this has helped, but I have made my fork less plush by doing that.
